Depends on what caused the killing. If you are in your house minding your own business and someone breaks into your house attempting to rob you with a weapon and you kill them, that's justifiable self defense(My Mom's friend had a son who was killed when attempting to rob a house). Now murdering someone because they cheated on you is not considered justifiable self defense and the murderer is liable to be in prison for years if Convicted.
Depends on what state you live in.
Texas has a "Sudden Passion" law
What would be 1st or 2nd degree murder in most states is reduced to manslaughter under Sudden Passion Statute.
Most convicted under the "Sudden Passion" law, will serve less than 2 years. Some even walk free...
Up until a couple decades ago this was a male only privilege. Now females can claim sudden passion as well.
In some places such as Brazil this act is Justified Homicide.
The moral of the story is, if your are going to cheat on your spouse... Don't do it in TEXAS!
