    bfbagain: Optimism reigns!


    Congrats to James Grosjean, and of course Bob Nersesian, for fighting this fight.

    In a perverted sense, we should probably thank the Imperial Palace, along with Caesars Palace, and although a little premature, The Mandalay Bay, though they're not directly involved in this case.

    Now hopefully, the report of this case will go beyond the borders of Nevada, although I'm reasonably confident it already has, at least it's known throughout casinoland, USA.

    We'll really feel good, if picked up by the mainstream media.

    bfbagain: Just to clarify, We (I) really need to thank

    every player, who has ever been threatened, physically abused, arrested, kidnapped (back-rooming) or any other nefarious act committed by casino goons who have had the courage to stand up and fight this through the legal system, along with all the attorneys who have been indefatigable in their support of advantage players.

    Thanks to you all. It is appreciated.

    If I read the story correctly, he only sued the Imperial Palace. Are they pursuing action against Caesars (detained him for 5 hours!) or the police department/county (detained him for 4 1/2 days!)?

    Well, let's just say that filing a lawsuit under a phony name probably would not do much for your case.

    This is one of the reasons that more of these lawsuits are not filed. AP's generally try to maintain as low a profile as possible, for obvious reasons.

    In addition, when such lawsuits are filed, the casino will usually offer to settle out-of-court for an amount that is trivial to the casino, but may be non-trivial to the AP involved, typically $10-$20K. Mr. Grosjean refuses to to take the easy money, and all advantage players benefit as a result.

    I'd also like to commend attorney Bob Nersesian. This is not the first case of this nature that he has handled, and it undoubtedly will not be the last. Most Las Vegas area attorneys would probably consider taking on the casinos to be career suicide.

    For a really interesting and intriguing story, the Spring 2001 issue of Blackjack Forum has James' story about the whole Caesar's scenario, from everything that happened in the backroom, to James' nights in lock-up, to calling Arnold Snyder to delay publication of Beyond Counting, and more.

    James' writing style really draws you into the drama, and it's one of the most enthralling stories even to be published in BJF, in my opinion. If you haven't yet read that issue, do it now to get the inside story. If you don't have it, e-mail me for information on how to order it.

    BTW, the title of the article ("A Funny Thing Happened on My Way to the Forum..." paraphrases the title of one of my favorite movies of all time and, if you know the movie, then it adds yet another dimension to the whole story.

    It's my understanding that every time this has been "settled," and the casino appeals, Grosjean's award gets bigger. Whether these are official appeals or just part of the ongoing process to this point, I am not sure, but I know for a fact that the award gets bigger each time.

    What makes you think that this ruling would be overturned? By who?

    At the risk of being crass, I'd place a modest wager that it won't. How about a years subscription to Don's Domain and Trackjack.

    Seriously, as much as it's against the Nevada court system to acknowledge that advantage players have rights, every once in awhile, truth and justice will make an appearance, even in Nevada.

    I don't really expect you to, and would advise you not to accept (my wager), as it really wasn't offered seriously, but if you are adamant in your belief, I could probably have my arm twisted to accept it.

    Regardless, it's a good thing for the AP community.
