    Trespassed and returning

    If a casino does not have my name but has trespassed me can I be arrested if I return? It was simply verbal recognition. I never signed anything or used a players card there before. I also never got anything in the mail, like I have at other casinos.

    I thought a "no trespass order" is only valid if signed or properly received (ie: been "served")? If it was simply oral, wouldn't that be the same as a back off? Or am I a little off?

    Hell, you can be arrested for doing anything or nothing. Not all arrests are legally justified, you know.

    I believe there's a court case that did not uphold a trespass simply for skilled play because the patron was not allowed the opportunity to leave before being arrested. I don't know if or where it would be a precedent.

    I've never heard of a trespass at any establishment where an arrest stuck if the patron hadn't been asked to leave. I'm not sure any cop would want to deal with the arrest without first pointing out that you can't be here and should probably leave.

    If it was for disorderly conduct, they might make an arrest. But for card-counting, I doubt it. Although, we shouldn't overestimate the legal knowledge of cops.
