    Mystic Lake Citation for Trespass

    So I got trespassed at Mystic Lake in Minnesota for counting cards. They evicted me from my hotel room and gave me a letter saying I'm trespassed. The problem was I still had chips left over and I was 16 hours from home so I waited 5 days then I went back to try to sneak in and cash some chips. Nothing happened during the cashout and I followed backroads and parked off property, but as I was walking to my car about half a mile from the casino a security car comes up and tells me they notified the police department and I'm being charged with a citation.

    Anyways, that's the back story. I got a citation for misdeamenor trespass. I called the Minnesota Court and they said I have to show up for court, there is no option to pay a fine. How serious is this? Is there a chance I will be sentenced to jail time? And should I get a lawyer?

    Googled Minnesota trespass
    Trespassing is a misdemeanor or a gross misdemeanor offense depending on the circumstances. A misdemeanor trespassing conviction comes with up to $1,000 fine and 90 days in prison. A gross misdemeanor trespassing offence comes with up to $3,000 in fines and a one year prison sentence.

    Yes, a lawyer is warranted - only my opinion. Depending on all details, you may have a good defence.

    I don't know much about anything. But I would think intuitively they needed to give you the right and option to "prompt payment" when they were initially trespassing you. Definitely you need an attorney as an attorney may be able to force them to drop the charges in order for you to not file a counter claim. As usual the casino wants to not follow all the rules and never wants to be fair. Talk with attorney brother.

    They did give me the option to cash, but I didn't have all my chips on me. Some of them were in my car. Also, I thought it was a bluff and they wouldn't care if I simply came back at a later time to cash out as long as I wasn't trying to play blackjack.

    I need to point out they went straight to aggresive trespass bc I went thru an independent host and received 3 comped rooms, 500$ freeplay, and 150$ food credit. So on top of all these freebies, they had to pay the independent host his commission. Plus I was counting. They really hated me.

    Also, why bother with the off-site parking (quite a hike) whilst giving up ID for comps?

    no i was parking off site once they trepassed me and i was sneaking back in to cash out chips bc i thought i could get away with it.

    In the 31st century, card counting in casino is a major crime. The counters will be sentenced life in prison without parole.

    I play Mystic and Treasure Island all the time.. Count cards at both but I use it for practice and build up my bank roll. I don't get aggressive in bets and I know when it's time to quit. First, you should contact the guys below. They might be able to talk with Mystic and work to have you cash out your chips. It's against the law to prevent someone to cash out chips or withhold payment I believe and hopefully they can work with Mystic to get the trespasse dropped as well since the only reason why you were going back was to cash out the chips which they denied you. HINT... I live in Minnesota and play both casinos for practice. When I go out to Chicago or someone where else I stay in a hotel AWAY from the casinos. I get an uber to and from.. WHY did you leave chips in your car of all places?? I don't take out a players card and I don't ask for comps... If you are going to be a player and count cards do it the right way.
