    It's a bit different here in Aus however. The effect is much the same but the method is different.

    Unlike the US, they can't 86 you without "good" reason (used very loosely here). If they did, you can actually take them to court for discrimination.

    I still don't think that's possible. The basis on which you can be discriminated against is fairly well documented. Counting isn't an accepted category.

    Casinos here don't have the right to pick and choose their customers however they like, unlike the US. For Victoria it falls under the Equal Opportunity Act 2010, which casinos must abide by as well. There's no exemptions. Being barred from any venue on an intellectual/intelligence/skill basis IS illegal in ALL states and territories of Australia. And card counting is clearly defined as not cheating in gaming legislation, so they cant bar you on that basis either.

    What doesn't stop them is legislation that allows them to bar "problem gamblers". Now it doesn't take a genius to figure out that they're unlikely to boot little old Nancy who blows her retirement fund everyday on the tables, but instead label suspected counters and give them the flick under said pretense.

    I don't believe the attribute you've described is captured by that legislation, nor any others.

    Even if I accept your argument that counting is not cheating and that casinos must allow counters who are considered skilled/intellectuals, the whole area of equal opportunity remains big a joke.

    In general, there are two kinds of intellectual discriminations: positive and negative. If you score 90? and Oxford University offers you a scholarship, it is an example of positive intellectual discrimination. If you get 60? in high school, Oxford won't allow you to even study there. This is negative intellectual discrimination.

    The casinos do the opposite, they allow dumb students with 60? marks (foolish punters) while banning students with 90? marks (elite counters). While a university selects positive intelligence and bar negative intelligence, a casino selects negative and ban positive.

    Since both negative and positive intellectual discrimination mirror each other, they both are one and same form of discrimination.

    Can a failed student use equal opportunity clause to get into Oxford or Harvard? If so, then counters can use the same clause as well.

    In practice, dumb students are barred to maintain profitability of the university. Same way, casinos ban smarter gamblers to maintain their profitability.

    Which is precisely one of the reasons/arguments Andrew Scott took to their VGCR in 1999. I suggest you read it. The Equal Opportunity Act 2010 IS Victoria's current anti-discrimination act. It covers discrimination in all forms.
