    Question about enforcement of a trespass

    I was trespassed a year ago at one of my haunts. In the process they asked me to show ID (since I was playing unrated) but I refused. The suit instructed the DoS to have me read the trespass act and sign it after cashing out. I refused to read the paper he tried to hand me and obviously refused to sign anything. I just cashed out and left without my vehicle so they couldn't run my plates (someone returned later to retrieve the car).

    Here's my question......When I decide the time is right to return; is anything enforceable since I showed no ID & did not read, have read to me or sign the trespass act? All they can go on, is that maybe I "look like a guy" they once told never to return. I've also lost 35 lbs since then so it's debatable that I even look like that guy anymore. I am thinking that the worst that can happen is if someone recognizes me they can only ask me to leave. Thoughts?

    They won't recognize you. As FYI, a trespass is legally only good for 1 year from the date issued in almost all cases. Also, if caught, do the same thing and just walk out the door. Do not put up a fight or argument, just leave peacefully. By doing that last time, it is unlikely they will recognize you and the personnel has likely changed in that time period.

    Listen to the latest GWAE with guest Bob Nersesian talking about this very issue.

    Very interesting was that it looks like no Caesars property can tresspass you in a way that is legally enforceable. Bob gives a long explanation of whynthis is so.

    I find myself in the same position as Jay.

    What do you suppose would happen if you're playng a carney game, have a big score and you need to show I.D. for tax reasons? Could non-indian casinos refuse to pay based on the previous tresspassing?

    If a player were to receive a notice of certified mail from an establishment they played rated at, what then? This player does not know 100% what was sent, but assumptions can be made. If said player never signs for delivery and never receives the intended letter, but has reason to believe the letter was a barring from the establishment, what actions could the establishment take against the player if they were to return and get caught?

    I'm traveling in the same vessel. My understanding is that a registered letter sent to last known address is sufficient in certain jurisdictions. But until it gets in front of a court one does not know. I think it would certainly be grounds for arrest, but arrest does not = conviction. If it happens to me I will PM you.

    So if you win 30-50k in a hand at a carny game like mississippi stud they make you show ID? I thought they just give you chips and no w2-g

    Depends if it's a side-bet with higher odds, or whether it's the main bet. Once the payout crosses a certain odds-threshold, taxes are withheld.

    For example, Firebet on craps - I believe only the top payout is taxed. LL on Blackjack, I believe only the highest payout is taxed. Feel free to correct me if I'm wrong though, but this has been my experience.
