    Backroomed and ejected

    I got caught in a bad situation not too long ago, and I did not handle it well.

    I had a large amount of chips from a previous gain and held on to them to avoid card counting flags. I went in again a few weeks later and noticed the casino had new chips with a slightly different design. So I figured I should cash out my old ones right away in case they might expire or something.

    Shortly after I came to the cage with the large amount of chips I was asked to go to the backroom where casino employees and law enforcement told me there had been a major chip robbery between my two trips, and they spent several hours detaining me for research and questioning. In an effort to cooperate, I gave them consent to search my car, and they also temporarily took away my laptop, cell phone, cash, and some chips I had from other casinos.

    Alone in a room with the officer and a gaming regulator, I was asked if there were some kind of illegal intentions I had with all my chips. I explained that I was holding on to them because I was counting cards, and they promised not to tell casino employees. Then, they immediately betrayed me telling the casino that I am a card counter. The casino knew I won my chips legally, so they cashed out all my chips and returned all my property, but they banned me. The law enforcement also told me that the casino's surveillance group would probably tell the other casinos in the metro area about me.

    I was not expecting this and didn't know my rights well, so I made a lot of mistakes. Will I really probably be shut down from playing in the whole metro area? I am young and have to provide ID to get in. Is there anything I can do to improve this situation after the fact?

    Don't play for a while, once everyone forgets your face from the flyers/OSN, you should be fine, IMO.

    All you had to do is answer their questions with yes or no. No explanations were necessary. You should've forced them to get a warrant to search your car. They had no right to conduct a body search or hold your property unless you consented.

    Yes, you are right, lots of problems with this event. Holding chips does expose you to this type of attention.

    Telling them you won the chips on a previous trip would have been OK, telling them you are counting cards was unnecessary and they punished you as a result. You were likely put in the OSN database but that does not mean you can not play elsewhere. If the pit thinks you are an AP, they will ask the EITS to review your play and they will find you in OSN and have you backed off. Play short sessions and move around between the casinos.

    They had no right to search your car or personal stuff, that could have turned very ugly. As soon as you knew they where taking you to a backroom you should have called an attorney.

    Use as a learning experience.

    Never had this experience but from what I have read and heard on this site, your best bet is to take your right to remain silent and as previously advised, call an attorney. The casinos have little or NO legal right to invade your privacy, hold you without cause, etc., but they BLUFF really well. I am with AndreTG in my curiosity about this casino being Tribal or not? They have different laws. Those evil ba**ards can make your behavior a FED offense due to the laws. I hate Tribe casinos!!!

    No, it was a high roller place in a big city, but one good thing is that it isn't a big chain.

One of the officers told me I shouldn't have taken more than 10k out of the casino because it is considered "structuring". They read me the miranda rights, and I was afraid I would go to jail on false accusations. But really I guess I should not have been so concerned since I didn't do anything wrong. Maybe I should not have voluntarily gone with them to the backroom.

    I am under the impression the police had no right to inform them your are an AP since you are not doing anything illegal and they broke their promise.

    You are so naive, it is easily inferred that you are about 21 years old.

    Trusting LOCAL police is absurd. State Police may not be much better.
