    mr bojangles: A misunderstanding.

    I do not think Rick is looking to sue or retaliate.

    I think he is asking whther or not he could be sued for returning after previously being 86'd.

    If indeed I am right, No Rick you acnnot be sued for returning, althought the offer contained within the mailing could be void.

    This is actually a complex issue, and one not really suited for discussion on an open message board. However, I can make a few general comments. I am not a lawyer, and this is not legal advice.

    It is not illegal simply to use an alias, providing that there is no intent to commit fraud. After all, actors and musicians do it all the time.

    US laws regarding "alternate ID" vary widely from state to state. In most states, it is illegal to possess forged government documents, and in some states it is a felony. There are other types of ID cards besides government documents, such as employee ID cards, trade association ID cards, etc.

    In "Chen vs. Monte Carlo" the Nevada Supreme Court ruled that the mere use of an alternate ID in order to thwart casino counter-catchers was not in itself illegal. Chen had been using a Burmese passport for ID. Since the country of Burma had not existed for at least 20 years, this was not a "forged government document."

    Things are much more complicated for someone who is not a US citizen, and I am certainly NOT suggesting that you use another identity. Fortunately, there are lots of casinos in Las Vegas, and you can return and play elsewhere whenever you wish.

    Someone returning to a casino where they had been previously 86'd could possibly be arrested for trespassing, although the mailing would tend to negate this.

    However, in practice, people who have previously been 86'd are usually simply told to leave, and no further action is taken provided that they promptly comply.

    Mail offers normally contain some small print stating that the offer may be modified or cancelled at any time.

    If you are trespassed and later receive an invite to come back, the case against you will be pretty weak if you are arrested and charged with trespassing. They invited you in.
