Difficult to see how this will come out. Depends on the exact phrasing of the law and I couldn't find the relevant New Jersey law in LexisNexis. Nevada law states "It is unlawful for any person to instruct another in cheating or in the use of any device for that purpose,...." If he was instructing the dealer in Mandarin to make moves that improved his odds, makes the case complicated. It may be difficult to use the ignorance of the casino as a defense.

Borgata got beaten fair and square. $9.6 Million, that's about 15% of their monthly revenue and probably 40% of their monthly table game revenue. No doubt someone had to answer for it considering it's Boyd Gaming who no doubt have to constantly slap themselves to keep from sweating the action like they do everywhere else.

Every casino I play at has countermeasures for this. Perhaps the dealer wasn't doing the simple countermeasure. I study everything the casino does to understand what weaknesses they are protecting. If a casino isn't doing the procedure that covers a particular vulnerability that may be all you need to get an edge. It has been a long time since I saw a casino not protect from this technique of getting an edge. Please don't expect me to post what they do to protect from this in the open forum.
