Thread: What is the threshold for officially being trespassed?

    What is the threshold for officially being trespassed?

    When being backed-off it is common to be asked to leave the casino. Assuming you have not been formally identified, what is the threshold at which you can consider yourself officially trespassed? Do they need to explicitly declare in a certain way that you are not allowed to be on the property? Is it sufficient for someone to just yell that "you will be arrested if you come back" as you leave the premises? Do you need to be formally identified/notified?

    Part of the casino's goal is to harass or intimidate, which means they may attempt to have you arrested regardless of the legal merits. Clearly someone needs to consider if it's even worth risking that experience. In the case someone is willing to deal with the harassment, yet wants to avoid a real conviction for trespassing, what things can/will be used to prove you are in violation of a trespassing ordinance?

    Until you actually sign papers that say something to the effect of:

    I the undersigned, agree to never return to XYZ Property and if I do, I will
    be subjected to arrest for trespassing under Nevada State Code 207.2.

    Then all the casino can do is harass and intimidate. They call it
    reading the trespass act to you. It's not legally binding until those
    papers are signed.

    That is not true. If the casino can show they READ it to you, it's binding. A signature acknowledging it is not necessary.

    WRT to the backoff - there are a number of variations, regardless of what the casino does your basic strategy is to just walk quietly towards then nearest exit, dont stop at the cage, don't get mouthy with the boss, dont sign anything, dont show ID and never volunteer to be detained. If they wont let you leave then call Bob (I assume he is on your speed dial) and review his advice on this topic for the right things to say as you are being detained.

    There is no threshold on how much you bet and you will get banned. It is more related to the player's capability, attitude, age and ethnicity, in that order. If you are a single young white male showing signs of counting, you are likely to be banned. Why waiting and ban until you perfect your counting skill?

    Exactly. If a casino asks you to leave and never return, that is considered a trespass. No formal papers needed. I’m pretty sure Bob N has discussed this several times on GWAE.

I am following his story since he moved from Pennsylvania to Las Vegas to be a professional Blackjack player. According to him, he has mastered Halves counting system during Covid 19 shutdown. When Las Vegas has reopened, he quickly up 82K using $25 to $250x2 spread. He said no casino bans him until a few days ago. But after the first backoff, every casino ban him from playing BJ. It is likely one casino sending his picture to all casinos at once. He asked if $25 to $250x2 spread that big a deal. My answer is that normally it is very acceptable especially for big casinos in the Strip. But being a SWM, that 20 to 1 spread might make you permanently banned from casinos even you are just a green/light black chip player.

    Really depends on the time frame Frankly, Zen King or whatever alias he goes by now is not emotionally capable of handling the ups and downs that most to need to go through to achieve the win discussed.

    I doubt that - maybe a chain - the Strip is far more tolerant than downtown, but even 2x250 at the big strip joints will get some attention eventually. Even playing non rated, you’ll be assigned a “name”, and the cumulative win will eventually get you.

    Now, the sweat joints downtown will bounce you first session at modest red chip levels. They’re some pretty funny stories about that.

    You don't have to sign anything. Casino merely needs to document the date and time contemporaneously and those business records will carry weight in any court proceeding against you. That said, unless you repeatedly return after being trespassed few jurisdictions will cite you without first giving you the opportunity to leave. Your mileage may vary depending on where you are. Tribal casinos tend to have the most extreme variety of actions. Some will actually steal your bankroll and boot you.

    He did not mention 'bans'. He doesn't believe casinos can ban him so he continually returns there. He just said he has been getting tossed a lot.

    I am not sure if it is temporary ban or permanent ban. But if he was backed off by every casino he walked in, I would assume it is permanent ban.
