    Need your Help !

    Hello guys,
    I have some questions regarding to paying tax and gambling in the U.S,
    appreciate in advance your help on this subject.

    First, let my clarify that i am not consider a professional gambler according to U.S tax law , because i currently visit the U.S for only three month,
    and the last time i have been here was 7 years ago, so in between a 3 years period, i have only visited U.S one time, , ( knowing by reading a U.S gambling tax book, i hope i am right on this one ).

    My questions are:

    1. If i am leaving the U.S with more money, do i have to pay 30% tax, for example lets say i have entered and declared for 20,000$ and now i am leaving with
    30,000$ will they reduce 30% percent from the 10,000$ i have won in the casino ?

    2. What proof do i have to bring to the customs officer , so he will actually believe that the 10,000$ win is actually a wining money from the casino ?
    (i thought about taking a pic of me next to the store, as well as show him a detailed excel file of my wining and losses, perhaps even considering recording the
    conversation in the store cashier using my spy iPhone app so the date the location and the amount of money will be recorded as well).

    3. If i considering sending part of my money using wire transfer to my bank out of U.S is there a different between my marked bills that i have declared in the
    customs and wining money from the casino, do they ask questions if they find out this is not the money i have declared , what reason do i have to give them
    for transferring the money, in this case i want to make multiple transaction each for 4000$ so the total transaction amount is more then 10,000$.

    Let me mention also that i am only playing table games,
    so my winning from blackjack is totally differ from a guy who is playing slot in a matter of paying 30% tax, but how can i prove i am only playing blackjack ?

    Customs shouldn’t be taxing your winnings. You wouldn’t be taxed until next year by the IRS. It may be the case that your country has a deal with the USA where you don’t pay US taxes, do your own research. If you are worried about customs, say that you won the money gambling and have hotel receipts, souvenirs from casino, pic of you in front of casino, etc.

    Answering by number relative to your questions.

    1. Are taxes payable on gambling winnings in your home country. Further, you were almost certainly required to declare currency in your home country prior to departure. Keep a copy of that document with you. Further, you are not required to pay taxes to US customs upon leaving the US. If you are not required to pay taxes in your home country on gambling wins, then your home country likely considers this to be a windfall. The corresponding tax treaty between your country and the US likely says that taxes and tax returns are not required. Note that the law will differ if you are considered as a professional gambler, in which case, US wins would be declared as income in your home country at those prevailing rates.

    2. Don’t overdo this. The detailed excel file should do it. Don’t tape conversations at the cage. It might be misconstrued, if caught, and you don’t need that aggravation.

    3. I don’t think so. However, you can safeguard yourself in 2 ways. The obvious one is that you declare currency at the first international airport, prior to departure from the US, where there is a US customs office. The form doesn’t specify amount. It simply asks if you are declaring a value in excess of USD 10000. The agent will then ask how much currency are you declaring. You then tell him either - I have in excess of USD 10000, and I have previously wired 5000 to my home country bank account, or, I have USD 5000 on me, and I have previously wired USD 5000 to my home country account. The customs agent will then advise if you actually need to declare or not on any physical amount on you which is less than USD 10000, or if you’re carrying 10k or more, wheather you need to also declare the wired amount. The second way is simply to phone the US customs office at your designated airport of departure and ask, prior to flying to the US.

    Your last question is simple enough. You are playing table games only, because only slots and certain side bets are subject to immediate withholding, you would simply show a receipt where tax was withheld. Not to be construed as professional advice.

    One last point. It would be an idea to keep a copy of your bank receipt showing withdrawl of funds in your home country. They’re several places to and from the USA where this would prove to be useful.
