Thread: Effective 8/1/2018 Card Counters Can't be Kicked Out of Louisiana Casinos

I was recently backed off at a couple of stores in Louisiana. I asked if I could return to play after August 1, but the Managers seemed to be ignorant (or feigned ignorance) of the change to the law. One place said I was prohibited to play blackjack but could return, and the other said "you're 86ed" -- I guess she thought it sounded cool to say it this way.

The way the new statute is worded only talks about not being able to exclude a person from a gaming establishment based solely on skill level, so it may be interpreted to be able to exclude an AP from certain games but not from the establishment. I'm not a lawyer so my interpretation may be off base, or it may need to be adjudicated so a court could apply the correct interpretation.

I agree with your view; i.e., they can probably back you off of specific games, but can't "86" you. So it's not a great deal for APs, but as I mentioned before in this thread, I would much rather have a polite back-off from a BJ game rather than a heavy-handed security escort....

This is a non-issue as it has been unlawful to bar a
person SOLELY because he is smart enough to win.
Several states have operated this way for many years.

Casinos often manufacture excuses to exclude a player.

I card counter that I know was recently escorted off-site
because of a manufactured excuse that other players had
complained to management that my friend "smelled bad"

This occurred in Maryland. There was no truth to the claim,
but any excuse will result in the same effect.

A person may not be excluded from a gaming establishment operated by a licensee or the casino operator for reasons based solely on the skill level of the person.
'...based solely on the skill level of the person.'
Couldn't they just bar you for some other reason so it is now not solely based on skill level and kick you out? Or could they ever class advantage play as disruptive conduct? Perhaps permanent counter-measures and generally worse conditions for all will be the only result...
