    Giving ID to casino personal

    When you go to cash out your chips and they ask for ID I have almost always given it to them. If you refuse to give your ID will they withhold your cashout? What do you do in this situation? I know once you hit 10k exchanged you need to, but what about at levels of 5k, 3.5k, or 1.5k??? Last time I cashed out a small amount at a indian casino, they requested ID. After they looked me up they kinda held back the chips and said hold on a second I dont know if I can do this. The boss came down and they tried to withhold my chips. I convinced them to give me my buy back in, but they stole the winnings.

    Woah! They stole your winnings??? I'm not exactly sure what the protocol for that is in an Indian casino, but I'm pretty sure they can't get away with that!

    As far as getting ID'd at the cage, every casino has a threshold. For example, all the casinos in my area will request ID at the cage if you cash out more than $3K. So I always try to stay below that threshold. Some casinos are different though; some places will ID you at $1K, so it just varies from place to place. I keep a chip inventory at my home base anyway, so I keep my cash outs below $3K and I'll pocket the rest of my chips if I book a large win.

    I'm not sure I want to give out that information. I will say it was in the upper midwest, and it is a place that no AP'er would bother with. I thought of going public with this at the time to hurt their image, but I did nothing. Knew i didnt have much recourse on their sovereign land. It wasnt a large amount, but it was the most anger I have ever felt being at a casino!

    On Munckin's radio show GWE he recently interviewed "Chairmain" who is active on the bj21 site.

    Chairmain recently was successful in a lawsuit against a casino on a reservation that had confiscated 9.5k from him. I think he said that it took 4-5 years and he had lots of expenses. So if it's a small amount of chips it likely not be worth the effort.

    I recall this happening in rural Mississippi a while back where all chips were seized.

    There is no (actual) recourse.

    Good tips there ryemo. I will say I have had no other negative experiences with backoffs at other tribal places. It might just be the one individual this time. I told them if I dont get my money there will be a shit storm coming down on this place. The 250lb native with a ponytail got about 10inches from my face and screamed, "ARE YOU THREATNING ME!?" This was on the casino floor. My brother was with and calmed the situation and convinced them to return my buy in.

    Because i was previously backed off so I should not have been playing there. (it was years before, and I had played a couple times since) I told them that they should not have accepted my bets. he said, well you snuck by.

    So this was because you were previously backed off and they asked you not to play, but they did not trespass u? Still think that this is a very harsh outcome with very little recourse.

    I think Nercessian (sp?) Suggests calling/demand they call gaming if the cage tries to withhold your chips. Not sure how effective it'd be on a tribal casino that you've previously been removed from, but it seems like the only chance you had.

    is generally a waste of time. They are sovereign. Even the U.S. Supreme

    Court handed down a decision - that is "case law" - that American Citizens

    are WITHOUT Constitutional Rights and Protections ~ on reservation property.

    Zen, this is not necessarily so on all tribal lands. It all depends on the agreement the tribe has with the state. Bob has a very good discussion about this on one of RWM's pod casts. The problem is of course knowing what that agreement is on the front end.
